By using ByteUp's services, you agree to be bound by these Terms of Service, our Privacy Policy, and any additional terms applicable to specific services.

2. Description of Service

ByteUp provides web hosting, game server hosting, VPS hosting, and related services. We reserve the right to modify or discontinue any service at any time.

3. Account Registration

To use certain services, you must register for an account and provide accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials.

4. Acceptable Use

You agree to use our services in a manner that complies with all applicable laws and regulations. Prohibited activities include:

• Illegal activities
• Hacking, spamming, or distributing malware
• Harassment or abuse of other users
• Violation of intellectual property rights
• Any activity that disrupts or interferes with our services or network

5. Payment and Billing

You agree to pay all fees associated with your chosen services. Payments are due as specified in your billing cycle. Failure to pay may result in suspension or termination of your account.

• All fees are non-refundable except as described in our 24-Hour Refund Policy (Section 6).
• We reserve the right to change pricing at any time, but will provide notice before any changes take effect.

6. 24-Hour Refund Policy

We offer a 24-hour refund policy for new hosting services, starting from the time of purchase. To be eligible for a refund:

• You must request the refund within 24 hours of the initial purchase.
• The service must not have been used in a way that violates our Acceptable Use policy.
• Refunds do not apply to domain registrations, SSL certificates, or dedicated IP addresses.

7. DDoS Protection

While we provide DDoS protection, we do not guarantee complete immunity from attacks. We are not liable for any downtime or service interruptions caused by DDoS attacks.

• Users are prohibited from intentionally initiating or participating in DDoS attacks.
• We reserve the right to null-route or otherwise mitigate attacks that affect our network.

8. Resource Usage

You agree to use server resources responsibly. Excessive use of CPU, bandwidth, or disk space may result in account suspension or termination.

• Unlimited plans are subject to fair usage policies.
• We reserve the right to limit resources to maintain the stability of our servers.

9. Data Loss

While we perform regular backups, we are not responsible for data loss. You are responsible for maintaining your own backups.

10. Termination

We may terminate your account for violation of these Terms of Service or for any other reason, with or without notice.

11. Disclaimer of Warranties

Our services are provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement.

12. Limitation of Liability

In no event shall ByteUp be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our services.

13. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of Romania.

14. Changes to These Terms

We may update these Terms of Service from time to time. We will notify you of any changes by posting the new policy on our website.
